In accordance with Directive (EU) 2019/1937 and Italian Legislative Decree no. 24 of 10 March 2023, any staff member, collaborator, volunteer, partner, consultant, contractor or any other person associated with Un Ponte Per may report, even anonymously through a dedicated platform, illicit practices, fraud, abuse, violations that put at risk the interests of the communities supported by Un Ponte Per or of the organization itself.
DEFINITIONS
Whistleblowing is a term that refers to the act of reporting unlawful conduct within an organisation. This means that if a UPP staff member or volunteer believes that there are unlawful practices in the organisation's workplace, they can report it by following the correct processes set out in the dedicated Policy and their rights will be fully protected.
Illicit practices/violations
are defined as behaviors, acts or omissions relating to violations in the dedicated Policy of which the reporting person has become aware in a work context. This includes all administrative, accounting, civil or criminal offenses.
PROTECTION OF THE REPORTER AND THE REPORTED
Great attention is paid to the obligation of confidentiality regarding the identity of the reporting person, which cannot be disclosed, without his or her explicit consent, to anyone other than the authorised personnel responsible for receiving or following up on reports.
Confidentiality is guaranteed, on the one hand, of the identity of the reporting person, of the person reported and of the other subjects involved or mentioned in the report and, on the other hand, of the content of the report and of the related documentation in relation to the internal and external reporting channels.
HOW TO REPORT
The reports will be reported only to the Supervisory Body (OdV) . This may avail itself of the support of the staff and the board of directors (National Committee) if it deems them useful and appropriate. The report can be provided in written or oral form (registration) via the following platform reachable at this address: https://segnalazioni.unponteper.eu/#/ .
The information in the form can be entered anonymously, is encrypted and accessible only to the OdV. The reporting person will receive confirmation of receipt of the report within seven days and will be informed about the management of the report. The reporting person will be given feedback on the outcome of the report within three months from the date of receipt of the report.
WHAT TO REPORT
Reports may concern, according to the reasonable belief of the reporting person, violations of national or European Union provisions concerning:
- Illicit conduct pursuant to Legislative Decree 231/2001 or violations of the organizational and management models provided for by that decree.
- Illicit conduct in specific sectors such as public procurement, financial markets, prevention of money laundering, transport and product safety, environmental protection, food safety, public health, consumer protection, privacy and cybersecurity.
- Acts that harm the financial interests of the European Union pursuant to Article 325 of the Treaty on the Functioning of the EU.
- Violations of the EU internal market, including competition, State aid, and tax rules that hinder the objectives of corporate tax legislation.
- Behaviors that undermine the purposes of EU provisions in the sectors indicated above.
